Judge tells convict to earn a living the halal way GEORGE TOWN: A High Court judge advised a former odd-job labourer who pleaded guilty to a lesser charge of drug possession to choose a halal way of earning money. “There is only one legitimate way of earning a living, which is the proper and halal way,” Justice Abdul Rahim Uda said when passing sentence on Mohd Rizi Che Salleh, 28, yesterday. Mohd Rizi, represented by K. Simon Murali, was jailed nine years from the date of his arrest on May 1, 2002, and ordered to be whipped 10 times after he pleaded guilty to possessing 991.7gm of cannabis. He admitted committing the offence at the Juru rest area in Seberang Prai Tengah at 4.30pm that day. He had originally been charged with trafficking but the charge was amended by the prosecution yesterday. Mohd Rizi, who has been in detention for the past seven years, looked relieved upon hearing the sentence. He smiled and shook hands with his lawyer, as he would only have to serve the whipping sentence following the one-third remission on his jail term. According to DPP L. Uma Devi, police were waiting at the rest area in an ambush at about 3.30pm when Mohd Rizi arrived an hour later. He parked his motorcycle and made a call from a telephone booth when police arrested him. “Police did a body search and checked the motorcycle basket where they found a compressed block of cannabis wrapped in a black plastic bag and covered with a raincoat,” Uma said. Simon Murali urged the court to take into consideration Mohd Rizi’s plea of guilty as a strong mitigating factor. “His guilty plea saved the court’s time, expenses and helped clear the number of backlog cases,” he said. He also said that his client was a Form Two dropout and the eldest child in a family of eight siblings. “He is a first offender and also a youthful offender. He deeply regrets his actions, which he attributed to mixing with the wrong company,” Simon Murali added. Uma urged the court to impose an appropriate sentence. |

Australian judge jails Malaysian cocaine trafficker BRISBANE : A judge sentenced a Malaysian woman Friday to eight years in prison for smuggling cocaine from Brazil into Australia. Customs officers arrested Ramia Binti Jimson, 46, at Brisbane International Airport a year ago after finding more than four pounds of cocaine hidden beneath a false bottom of her suitcase. Prosecutor Glen Rice told the Queensland state Supreme Court on Friday that Jimson had been selected for a random bag search on arrival from Brazil. Defense lawyer Dennis Lynch said Jimson, who pleaded guilty to drug trafficking, was offered $2,000 to smuggle the drugs, which police estimate had a street value of more than $1.3 million. Jimson planned to use the money to improve her poverty-stricken life outside Kuala Lumpur, Lynch told the court. Judge Peter Lyons sentenced a tearful Jimson to eight years in prison without the possibility of parole for four years and six months. She had faced a potential life sentence. - AP |

Commodities settle mixed after wild day on Street NEW YORK - Commodities were mixed Thursday as some investors cautiously waded back into the market in search of bargains after a huge rally on Wall Street. Gold and other precious metals prices fell, but rebounded in electronic trading after-hours. Energy and agriculture futures mostly rose. After three days of selling that wiped out about $1 trillion in shareholder value, Wall Street launched a massive rebound Thursday, driving the Dow Jones industrial average up more than 550 points. Earlier in the session, the Dow had fallen near its lows for the year. "The commodities that closed early today didn't get much of a benefit ,'' said Rob Kurzatkowski, a futures analyst with optionsXpress. "After-hours, commodities are doing very well, riding the coattails of the equity market.'' Commodities prices have taken a beating in recent weeks, as investors worried that a prolonged global economic slump will lead to a sharp drop in demand for basic materials. Wall Street, likewise, has also seen heavy losses, spurred by investors' concerns over the economy. "You're seeing some value buying going on, just like you are in the equities markets,'' said Kurzatkowski. "These markets have been so battered down in recent months, I think you are seeing some traders with longer-term perspective getting back into the market.'' "I don't think we're seeing much of a reversal in trend, so much as some short-lived enthusiasm,'' he said. Gold for December delivery dropped $13.30 to settle at $705 an ounce on the New York Mercantile Exchange, after falling as low as $698.20 earlier in the session. Prices have not dipped below $700 since Oct. 24. But gold rallied $17.90 to $736.20 in after-hours electronic trading on the Nymex. December silver tumbled 68 cents to $8.80 an ounce, while December copper futures fell 3.15 cents to settle at $1.6240 a pound. Copper was up 6.95 cents to $1.7250 a pound in aftermarket trading. The U.S. dollar was mixed against other major currencies Thursday. The yield on the benchmark 10-year Treasury note rose to 3.88 percent from 3.67 percent late Wednesday. Light, sweet crude for December delivery rose $2.08 to settle at $58.24, after earlier falling as low as $54.67 - a price last seen in January 2007. Oil prices have been hampered in recent sessions on concerns that energy demand will continue to fall. On Thursday, the International Energy Agency slashed its demand forecast more than it has in a decade. The agency now expects global oil demand to average 86.2 million barrels a day this year, nearly flat compared with 2007, and 86.5 million barrels a day next year. In other Nymex trading, heating oil futures fell 4 cents to settle at $1.875 a gallon, while gasoline prices rose 5.4 cents to settle at $1.3024 a gallon. Grain prices, meanwhile, mostly rose on the Chicago Board of Trade. December wheat futures rose 5.25 cents to $5.5875 a bushel, while corn for December delivery rose 7.5 cents to $3.77 a bushel. Rocker Amy manages to strike out suit filed by 3yr-old (updated) KUALA LUMPUR: Amy of rock band Search succeeded in his bid to strike out a negligence suit brought by a three-year-old boy. Sessions Court judge Sabariah Othman allowed his application to set aside the civil suit and awarded him the costs, which had yet to be ascertained. Amy, whose real name is Suhaimi Abdul Rahman, was cheerful upon hearing the court decision Friday. “I did not expect that it could led to the court action. I did not want this kind of thing to happen as it creates a bad image,” he said when met outside the courtroom in Jalan Duta here. The boy, Nik Muhammad Zakwan Nik Zahir, had filed the suit on Sept 24 last year through his father Nik Zahir Nik Mohd Idris. Nik Zahir claimed that his son had been scalded by hot tomyam soup at the rock star’s restaurant in Wangsa Maju here on June 17 last year. Amy sought to strike out the suit on the grounds that he was sued in his personal capacity and not as a director of Iconhill Sdn Bhd which owns and runs Cheng Ho Chinese Islamic Seafood Restaurant. He said Nik Zahir did not have the power to institute the suit on the boy’s behalf after failing to furnish documents required by the Rules of the Subordinate Court 1980. Amy’s wife Nor Hasniza Hassan, who accompanied him, said she was glad that the suit was over. When asked if Amy would settle the case with the boy’s family, his lawyer Ahmad Zaharil Muhaiyar interjected that “We are willing to meet the family at all times. We are willing to sit and talk with them.” At the outset of court proceedings Friday, Ahmad had argued that the suit should be struck out on grounds that the boy had named the wrong party to the suit. “He had been sued on his personal capacity when the business was done by the company Iconhill. Amy is a shareholder and a director of the company. They are two separate entities,” he submitted. The boy’s lawyer Adnan Seman said later that he would appeal the decision. |

We moved on,” Microsoft chief executive Steve Ballmer told a business luncheon in Sydney yesterday when asked about the company’s plans after a partnership between Yahoo and Google Inc fell through this week. “We tried at one point to do a partnership around search ... and that didn’t work either, and we moved on and they moved on. We are not interested in going back and re-looking at an acquisition. I don’t know why they would be either, frankly,” Ballmer said.
