William S. Mudd
W. S. Mudd. Though not, by right of nativity, an Alabamian, the subject of this sketch, from infancy to the grave, lived and prospered in this world's honors and its goods in Jefferson County.
Born in Kentucky in 1816, he came to Alabama in 1817 and gathered his first intuitions in the beautiful border land of North Alabama, in Madison and Lawrence Counties.
Little is known of his early instruction in Jefferson, where he received his academic education, but some of his old schoolmates still surviving remember him as a quiet, resolute, discreet, and brave boy, neither very social nor yet repulsive in his manners ; always modest and yet ambitious ; just the kind of boy to possess a magnetism over his fellows and to keep on a little higher plane than they. These characteristics were prominent in his whole career, showing themselves in the old man with greater distinctness than when, in the noon of his vigor, they were kept in abeyance by stronger passions and more urgent thoughts.
The education of the young man at college was in harmony with his natural inclinations. It was gained upon the medium ground between the puritanic and the chivalric. It was encompassed by the golden mean of discreet conservatism. This was the path into which he was led and kept while in the classic walls of St. Joseph's College, Bardstown, Ky.
In that day and time it was not easy for a young, ambitious, and brilliant man, with no special religious bias, to escape personal difficulties and encounters. But, though notedly brave and chivalrio, his walk was held with such shrewd discretion, in his chosen path of peace, that strife and bitterness seemed to keep afar off from him.
Kentucky has furnished Alabama some noted men, among the number the two Baylors, both men of culture and high intellect— if not the gift of genius. In the office of W. K. Baylor, Esq., young Mudd received his first lessons in the lore of law books. Doubtless the teacher has more to do with character building than we are apt to imagine, and if he be a man of strong will and magnetism, the young under his tuition being of the plastic kind, will receive impressions which mature into habits as lasting as life. Young Mudd's opening career showed the hand of the master. If the line of Wadsworth be true, that "The child is father to the man," we are enabled by having a knowledge of the boy to infer the history of the man's whole life. We have here known the man, and by reasoning backward we have here learned the boy. He was well taught from earliest manhood. At the age of twenty-three we find him in our legislative halls, by the side of Jere Clemens, of Madison, and L. P. Walker, of Lawrence, and W. L. Yancey, of Coosa, together with a brilliant galaxy of young " solons," many of whom became, in after years, great in the forum and field — jurists, lawyers, soldiers, and literati. From this early stage, on to the close of his life, honors of one kind or other awaited him. For three terms he sat in the legislature, and by his wisdom and legal acumen was in the front rank of those who shaped the destinies of our people. Stepping from the legislative hall he took the State solicitorship, with its arduous responsibilities. From the solicitorship he stepped into the circuit judgship. From the bench, which he held through many popular elections for near thirty years with undiminished confidence, the strong arm of death only removed him. No Alabamian ever pursued more remarkable a career than Judge Mudd From earliest manhood popular and admired, till the last flickering of life's spark, he retained his hold on the affection of the masses
and the respect and admiration of our most distinguished citizens.
His name is now a household word in Jefferson, Walker, Marion, Blount, and other counties, where the people's differences for so long were tried before him. His memory is part of the history of these hill country people. His individuality was of so marked a character that it amounted almost to genius. So eminently practical and just were his motives that it was a habit with him to sit apparently idle, in the deepest musing for hours, analyzing the cases that were to be tried at his tribunal, researching for the bottom principle of the matter in dispute, delving down beneath the cloak of legal
technicalities and prying into the heart of it for the silent equities hidden beneath. He loved justice! A few weeks before his death he said to the writer of this sketch: "The judgship is a thorny honor. I have often been in perfect anguish when cases of great crime came before me. Night after night I have read and studied the evidence for and against the prisoner, and have always dreaded lest I might cause the destruction of an innocent person. In trials of the rights of property I have studied hard the best authorities for weeks and months, and yet when the case had come up for judgment I have found my mind and heart deeply pained and in a struggle of

Legal Methods III Students Present Widener’s Legal Clinic With Informational Brochures on Fair Debt Collection Practices Act
Legal Methods III Students Present Widener’s Legal Clinic With
Informational Brochures on Fair Debt Collection Practices Act
On Friday, February 26, 2011, students from the fall semester’s Writing for General Practice class presented copies of their finished “Know Your Debtor’s Rights” brochures to the Law Clinic staff. Three different brochures, selected by the staff at the Law Clinic, will be used to educate the Clinic’s clients who are seeking help on debtor-creditor issues.
At the request of the Law Clinic, Professor Alexandra Makosky’s Writing for General Practice class researched the Fair Debt Collections Practices Act, 15 U.S.C. § 1692c, and translated the law into plain English for the Clinic’s clients. Students met with a graphic designer to learn some professional lay-out tips, but then spent their time focusing on the words so that they could be understood by non-lawyers.
“We see this project as a win-win situation,” said acting clinic director, Monica Cliatt. “The Clinic now has some great informational material to give to our clients who need to know about their rights under the law. The students learned how to write effective and eye-catching material addressing a current, real-world issue plaguing many households. We are thrilled with the end products and are grateful for Widener’s Legal Methods leadership.”
Director of Legal Methods, Anna Hemingway, commended students Aaron Vogt and Edward Wilson for their professional work, and she hopes that additional joint projects can be arranged in the future. “The students loved having the opportunity to solve a real-world matter. They learned that choosing the right words to explain the law is a powerful tool in our profession.”
Aaron Vogt and Ed Wilson both acknowledged that this project taught them practical legal skills and helped them realize the positive impact the legal profession can have in the community.

Right to Freedom-of-Movement in the EU, regardless of medical condition, physical- or cognitive-handicap: EuroParl Dec.1 2009 on Vimeo by Noel McCullagh
Watch this? Google: " vimeo mcula "
-
Noel McCullagh (33) moved to Netherlands in 1998 for research purposes, thanks to an EU study-grant. 8 yrs later, MS rot was discovered in his brain and CNS, after 5-years of intermittent, serious illness including back-surgery and a plethora of other misdiagnoses along the way.
Unfortunately being repeatedly misdiagnosed is an all too common feature of multiple sclerosis, which is located in the brain and therefore effects every conceivable aspect of a person's health as it develops, grows and expands inside their skulls and along their spinal chords.
Ever since that (successful) diagnosis in 2006 revealed the underlying medical brain-disorder was MS, medical treatment began with Bedrocan® and Bediol®. Other medicines prescribed beforehand proved unworkable due to the harsh pharmacokinetic interactions persons being administered multiple drugs experience and the adverse affects that such practises cause for the individuals concerned.
After successful treatment commenced, and the blindness subsided, McCullagh was once again healthy and fit enough to make the long journey home to visit his parents for the Christmas holidays; the first trip to his mother and his father in western Ireland since the diagnosis earlier that year in the summer of 2006.
However, he was halted from entering Ireland under the authority of Dublin's ever-dubious minister of health and children, Mary Harney TD. Her departmental officials, under her orders, have stated in no uncertain terms that they will endeavour to have McCullagh arrested and locked-up as a common criminal should he attempt to set foot in the jurisdiction of the southern-Irish republic for whatever reason (including democratic elections).
BACKGROUND TO PETITION No.590 of 16 April, 2008
On 08 April 2008, the Irish minister for justice, equality and law reform, Mr BJ Lenihan TD, revealed to the Irish parliament, and on the record, that McCullagh was chronically-ill with a clinical condition serious enough for him to be medicated with cannabis-derived medical products. There are only 5 illnesses for which Bediol® and Bedrocan® (dronabinol-based medicines) are legally prescribed as medical healthcare within the Union and all are chronic, potentially-deadly diseases. Persons diagnosed with any of these serious illnesses have a right to keep the diagnosis in the private, personal domain.
BJ Lenihan TD's actions, placing privy and confidential details -- facts taken directly from the official Schengen Medical Certificate documentation (part of McCullagh's private Netherlands medical-dossier) -- into the public domain on 08 April 2008 in the Irish parliament was wrong and ill-conceived by the minister's informants and various assistants.
McCullagh, therefore, had no option but to take immediate action in the EU institutions to seek a resolution to the issue before even more of his private medical-details were revealed in public by the members of the Dublin government.
Denied the right to appear in the Irish republic by threat of unlawful arrest from officials of the Irish minister for health Mary Harney TD, of the Dublin government, and therefore unable to commence any manner of procedure in her republic, the European Union institutions were (and remain) the only organs from which McCullagh is physically able to seek redress. Travel to Brussels, or to Strasbourg (the states where those cities are located are full-members of the European Union), is fully in accordance with the Law of the Union and the Rights of Citizens of the Union.
One year and eight months after the petition was submitted on April 16, 2008, the matter was heard before the European Parliament on 01 December, 2009 [the day that the European Reform Treaty entered into legal effect]. This video contains those proceedings. It must be noted, however, that the interpretation does not constitute an authentic record of proceedings.
The original version of the petition is in the (general) Nederlands language; as this is the working and daily-language of the petitioner.
An English-language version is located here:

MEDICAL MATTERS - related general information.
Palliative care refers to medicines and treatments not aimed at curing the disease, (that is not humanly possible) but rather to treat the manifold and various symptoms of this neurological and autoimmune disease. Take diabetes for example: insulin does not cure the underlying condition but is a vital nonetheless.
In other life-threatening illnesses, such as AIDS and CANCER, the prescribed medicines both increase the calorific intake of the patients as well as staving-off the nausea and vomiting that make it impossible for CANCER and AIDS patients to ’hold-down’ and ’digest’ their vital, daily, medicines.
Full details relating to this element of medical intervention may be located at the following address:

Moma -16 Frida Kahlo - Fulang-Chang and I 1937
Frida Kahlo - Fulang-Chang and I 1937
Frida Kahlo de Rivera (July 6, 1907 – July 13, 1954; born Magdalena Carmen Frieda Kahlo y Calderon)[2][3] was a Mexican painter, born in Coyoacan,[4] and perhaps best known for her self-portraits.[5]
Kahlo's life began and ended in Mexico City, in her home known as the Blue House. She gave her birth date as July 7, 1910, but her birth certificate shows July 6, 1907. Kahlo had wanted the year of her birth to coincide with the year of the outbreak of the Mexican revolution, because her life would begin with the birth of modern Mexico. At age 6, Frida was stricken with polio, which caused her right leg to appear much thinner than the other. It was to remain that way permanently. [6] Her work has been celebrated in Mexico as emblematic of national and indigenous tradition, and by feminists for its uncompromising depiction of the female experience and form.[7]
Mexican culture and Amerindian cultural tradition figure prominently in her work, which sometimes has been characterized as Naive art or folk art.[8] Her work has also been described as "surrealist", and in 1938 one surrealist described Kahlo as a "ribbon around a bomb".[7]
Kahlo had a stormy but passionate marriage with the prominent Mexican artist Diego Rivera. She suffered lifelong health problems, many of which stemmed from a traffic accident in her teenage years. These issues are reflected in her works, more than half of which are self-portraits of one sort or another. Kahlo suggested, "I paint myself because I am so often alone and because I am the subject I know best."[9] She also stated, "I was born a bitch. I was born a painter."[10]
_______________________________

Tears
I didn’t sleep well that night.Turned the television on twice to have a quick look. The prognosis was promising, on both occasions. Got out of bed at six‘o clock, pushed my captain-Kirk seat in front of the machine and put my headphones on.
He just started his acceptance speech. He seemed very cool and collected. He was not agitated or triumphant. He was glad but also realistic about the problems that needed to be solved. The part about the 106-year-old woman in Georgia, Ann Nixon Cooper, was an example of suberb storytelling. At that point the speech turned into a sermon, complete with a reference to Martin Luther King, and the crowd answering repeatedly to his call: “Yes, we can.”
I had allready spilt some tears, but when they showed Jesse Jackson in tears, this tough man who has seen it all, all my defenses were swept away. The speech had turned into a religious ceremony, trying to exorcise all that is evil and negative in the world. Yes! We could all be redeemed! If we just believed in our own power and never gave up hope. It took me at least half an hour to collect myself and I wondered, who didn’t cry, witnessing that wonderfull event in Chigago?
world's night
"The default of God means that no god any longer gathers men and things unto himself...the divine radiance has become extinguished in the world's history....the world's night is a destitute time...it has grown so destitute, it can no longer discern the default of God as a default."

CLARKE AND BARBARA DUNHAM
by Jessica Kane
One of the many things Clarke and Barbara Dunham had no intention of doing was buying their house in Pottersville.
It was a log cabin in the woods that had once been a hotel, built in
the late 1850’s. Charming, but falling apart.
“Definitely ‘as is’-ing,” added Barbara.
After much work, it is now quite magical, with perfect little nooks to
sit and read, surrounded by lush green plants, paintings and
unusual artifacts- all with interesting stories to tell.
Also on the property, is their studio, where Barbara and Clarke along with a team of 5 artists build and design from scratch
massive custom model train layouts- another thing the Dunhams
had no intention of getting involved with.
Up until 1987, Clarke was a very successful Broadway set designer. In
1984 and 1985 he had consecutive Tony nominations, which led to a lot of commercial jobs, one of which was designing and fabricating the Christmas train exhibit at Citicorp Center in New
York City, which features over 30 model trains, that pass through streets modeled after a bygone era in New York, and then travel all the way Upstate to the snowy Adirondacks.
The Exhibit was only supposed to run one season, but when they drew 141,000 visitors, somebody decided maybe they better do this again
Suffice it to say, they finished the 20th season last year.
The Dunhams never imagined that model train layouts would become their main focus, but over the years, that’s exactly what happened. They have now designed custom train layouts all across the country for private clients and
museums, even one in North Creek at the Depot Museum — a historically accurate reproduction of the train line from North River to Riparius. Barbara and Clarke first discovered the Adirondacks in the early 1970’s, when Clarke became the set designer for the Lake George Opera.
“Trains were not even on the distant horizon in our minds,” said
Barbara.
They fell in love with the area and came up to stay 21 years ago when
they built the first of the train layouts.
When they first began working in their Studio in Pottersville, the Dunham’s brought artists up from
New York City to build the train layouts, but they soon discovered there was more than
enough talent up here to fill the shop, so everyone who works there
today, lives here in the Adirondacks.
Clarke and Barbara both grew up in Philadelphia, where the arts were an important part of their upbringing.
“Clarke’s mother was my art teacher,” Barbara said.
Clarke and Barbara were married after Clarke’s first year of college, and they both went on to pursue fine arts degrees.
While Clarke was going to the city, sleeping on friend’s sofas,
beginning his career as a designer, Barbara was beginning a
successful career as a graphic artist, focusing on woodcuts.
They had four kids, who grew up immersed in the theater and the arts,
which provided first-hand experience of what it takes to make one’s
own way in the world.
The Dunhams have now been married over 50 years and their kids are
all grown and successful. Their eldest son is the Washington Bureau
Chief of the Houston Chronicle, their middle son is a lawyer who
recently argued a case at the Supreme Court, their youngest son is
with Reuters in Washington, and their daughter teaches drama and
playwriting at a performing arts high school in Virginia.
As for Clarke and Barbara, their careers don’t seem to be winding
down any time soon.
They’re booked well into 2010 for train layouts, Barbara is busy
looking for a publisher for a book she’s written about a Jewish boy
peddler in the Adirondacks, and just last week, they were in New York
City with the revival of ‘Candide’ at City Opera, which Clarke
designed.
They do, however, find time to enjoy the Adirondacks, which they both
love so dearly, whether visiting the Adirondack Museum, taking a dinner
cruise on Raquette Lake, or just going for a walk by the brook.
The Dunham’s may have had no intention of living the life they’re
now
living, but they certainly appear quite content.
