9-23-05 'alleged dui' results: wreck & injuries

Our friend, Jim, by the car. He got all of our belongings out of it. He even crawled into the trunk through the back seat to get everything out.

We were hit by an 'alleged dui' driver resulting in multiple soft tissue injuries, a rotator cuff tear and a SLAP tear for me, Paul's eyelid being sliced by our car hood coming through the window (I could easily have been widowed at 47), and me being knocked out: concussion or mild TIB / MTBI. I have no memory of the actual wreck. We were transported to the local trauma center, Harborview Hospital. I have a permanent softball-size bruise-appearing discoloration on my right calf due to a (medic's records) softball-size hematoma. People stare at it a lot. I've been branded by someone's choice to drink and drive.

This 'un's about 3/4 of an inch high, jes right fer a charm. Don't know why I'm talking like a hillbilly. I had no idea soldering would be so much fun, but now I've taken a right turn with my art. I put down the paintbrush, picked up the tin snips, and now I'm hacking into license plates, looking for the juiciest little letters. They get backed with contrasting piece of fabric, sandwiched between two pieces of glass, and soldered 'til the cows come home.

its amaizing what you find on the wall!!!

To be, or not to be: that is the question:
Whether 'tis nobler in the mind to suffer
The slings and arrows of outrageous fortune,
Or to take arms against a sea of troubles,
And by opposing end them? To die: to sleep;
No more; and by a sleep to say we end
The heart-ache and the thousand natural shocks
That flesh is heir to, 'tis a consummation
Devoutly to be wish'd. To die, to sleep;
To sleep: perchance to dream: ay, there's the rub;
For in that sleep of death what dreams may come
When we have shuffled off this mortal coil,
Must give us pause: there's the respect
That makes calamity of so long life;
For who would bear the whips and scorns of time,
The oppressor's wrong, the proud man's contumely,
The pangs of despised love, the law's delay,
The insolence of office and the spurns
That patient merit of the unworthy takes,
When he himself might his quietus make
With a bare bodkin? who would fardels bear,
To grunt and sweat under a weary life,
But that the dread of something after death,
The undiscover'd country from whose bourn
No traveller returns, puzzles the will
And makes us rather bear those ills we have
Than fly to others that we know not of?
Thus conscience does make cowards of us all;
And thus the native hue of resolution
Is sicklied o'er with the pale cast of thought,
And enterprises of great pith and moment
With this regard their currents turn awry,
And lose the name of action. - Soft you now!
The fair Ophelia! Nymph, in thy orisons
Be all my sins remember'd.

The original Clarence Block was destroyed by fire in 1899. This machine-cut sandstone building was built to replace it, and reopened in 1901. The building was owned by the Lougheed family and was named for Sen. James Lougheed's son Clarence. At one time it housed the law offices of Lougheed and his partner R. B. Bennett, later to become Prime Minister of Canada; as well as Max Aitken (Lord Beaverbrook) and John E. Brownlee, Premier of Alberta from 1925-1935.

Will you drink the water?

Will you drink the water?

As one Alpaugh resident speaks in support of the proposed increased water rate another asks him if he is willing to drink the water. He declined.

In Alpaugh, California the water looks, smells and taste bad. Alpaugh is one of the poorest towns in the California 20th Congressional District. The 20th Congressional district is the poorest congressional district in the United States.

Arsenic levels in the water exceed those permitted by law. Residents complain that they cannot drink it, cook with it or, for some, even bathe with it. The water provider want to raise the rates to $75.00 per month but there is no promise that the quality will improve.
Residents met with the staff from the Community Water Center (CWC) to ask for their assistance on help to get a no vote and stop the increase. A leaflet with no identifying information soon appeared in the community. It states that "A no vote stops the use of water", "throws our small domestic system into bankruptcy and leaves us without water." It urges the residents to "Stop the outside attorneys and organizers from destroying our small local domestic water system."
The community members came out en mass to the water board meeting. As I stood in the hot sun outside the Veterans building, I watched residents describe the water and the problems they have with it along with their inability to pay the amount sought. As people arrived to the meeting you could tell by the car they drove what position they would take on the issue. The few ones driving the sports cars and new pick up trucks, and dressed in a stereotypical grower style, supported the increase. Those who walked or came in older cars and wore older clothes were against the increase. Division by wealth was on display in a big way.
The hearing discussion was heated. Maria Herrera and Suzanna De Anda from CWC did an excellent job of translating the comments of the community members who spoke both against and in favor. Predictably, the meeting went late. The Board decided to take no action until August.

Stay tuned.

Construction site

This construction site is on the south side of Lake George. I don’t know what is being built so walking through it is the reverse of roaming through ruins and a pleasure that’s just as intense. It’s a present tense experience of abstract form in the state of becoming… electrical conduit snakes along a labyrinth-like route bordered by orange vinyl fence on one side and a cyclone fence on the other….the fences meander around 50-foot mounds of dirt,…at the site’s south end is an excavation with molds ready for concrete. As you move through this site, the failure of form to reveal its direction and purpose keeps you in the state of now, a state of wonder.

Conveyancing Handbook 17th edition

Conveyancing Handbook 17th edition

BOOK REVIEW

CONVEYANCING HANDBOOK
17th Edition

By

General Editor, Frances Silverman

ISBN: 978-1-85328-869-2

RESOLVE YOUR CONVEYANCING QUERIES QUICK!
ACQUIRE THIS INDISPENSIBLE REFERENCE FROM LAW SOCIETY PUBLISHING

An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers

In the competitive and constantly changing arena that is modern conveyancing, being up to date is an imperative for the practitioner. So, it’s good news if you’re a conveyancer, or involved at any level in conveyancing issues, that the latest edition (the 17th no less) of the Conveyancing Handbook is out now – one of the Law Society Publishing’s most recent publications.

Within its almost 1,200 pages, the Handbook places the collective insights and expertise of no less than 17 experts at your fingertips. All the pertinent aspects of conveyancing and its related disciplines are covered, from health and safety and the environment to agricultural law, financial and tax matters and a wealth of other topics.

Since the first edition was published in 1992, this scholarly and dependable publication has proved its value and its worth to literally thousands of conveyancing practitioners in England and Wales. Rather than a comprehensive guide to the law in general, the Handbook functions as your first point of reference to help resolve the many problems you as a practitioner are likely to encounter on a daily basis in the conveyancing of property; retail, commercial and residential. For further research, you are referred throughout the text wherever appropriate, to specialist works of reference.

As timeliness and topicality are of prime importance in conveyancing, this new 17th edition deals with all the new developments up to August 2010, including, notably, the introduction of the Building Societies Associations Mortgage Instructions, plus other legislation, including the Perpetuities and Accumulations Act 2009 and the Equality Act 2010. Other recent developments are also incorporated, including the new and updated Law Society practice notes which are of excellent value, especially those relating to anti-money laundering and gifts of assets. Amendments to the Solicitors Code of Conduct 2007 are also listed.

As you’d expect from a work of this scope and stature, there are extensive tables of cases, statutes, and statutory instruments, as well as a table of European and international law, plus -- a Directory of Land Registry and other addresses together with extensive appendices.

It’s easy to use and a thoroughly readable work of reference, so this is the Handbook you need to help you augment your understanding of this often complex field and provide best advice to your clients. The law is stated as at August 2010 and will resolve your conveyancing queries quickly.

Wayne Hampton and Arkansas' cypress-protection law

Wayne Hampton and Arkansas' cypress-protection law

PLEASE CLICK ON IMAGE TO VIEW photo of Wayne Hampton at Big Island and to read the column from 1990.

Articles recently in newspapers and magazines have reminded us of the disastrous Army Corps of Engineers projects that threaten the lower White River's habitat and the wooded wetland along its shores — land that offers some of the world's most important and rare wildlife habitat as well as an area that sequesters an enormous amount of CO2 in the mid-south region.

Congress continues to provide money for the lock and dam where the combined flow of the White and Arkansas rivers enters the MIssissippi River at Big Island, which is the subject of this 17-year-old column. For more about the lower White River and this project, get a copy of The Last River, which was published by the University of Arkansas Press.

A second project is abuilding upstream. It willl pump water from the lower White River to agricultural land.

Wayne Hampton was the second-generation owner of a 4,000-acre Grand Prairie farm. His father had begun building reservoirs on his own land to collect rainwater to irrigate his own crops. Wayne continued that effort and spoke valiantly of the need for every owner of large tracts of land in the Mississippi River Delta and especially on Arkansas' Grand Prairie to conserve water, to keep it where it fell, and use it rather than asking the government to bring water from the environmentally sensitive White River to meet the need for agricultural irrigation.
Even today, Rick Hampton maintains his father's tradition and uses water over and over, irrigating and then flooding a big stand of hardwood timber and selected fields for waterfowl and then pumping the water back to the storage ponds if winter and spring rain doesn't refill the on-farm reservoirs.

4/21/11 THE PROBLEM OF PORNO AT PUBLIC LIBRARIES, MAUNDAY THURSDAY

4/21/11 THE PROBLEM OF PORNO AT PUBLIC LIBRARIES, MAUNDAY THURSDAY

...so I'm sitting here @ B Library working on a project and the table I'm at happens to be right behind a public computer and a guy looking at pic after pic of naked or near-naked women and also various sexual images.....its clear as day from where I'm sitting...now I'm a heterosexual man myself and like woman, but I'm also a Christian and don't like to see women exploited for their bodies only, and am also concerned about the effect that non-stop porno viewing has on people such as this fellow...and what about kids in the library ? this is a serious issue.. not to say the body is bad,,,in fact the body is GOOD, God made Adam & Eve and said it was "good"...The problem isn't the body, nor the naked body, nor is the problem sexuality or sex in general (and since he's not looking at homosexual images I don't need to discuss that here)...the problem is just the "raw" gazing upon anonymous images, one after another, looking them up & down and all around without any shame..and also if it takes young men away from reality..from the healthy desire for the REAL THING Rather than pics of it.Of course in liberal society today if women, as well, are afraid of the REAL THING its a "vicious spiral"...and when I speak of the real thing I mean in a committed relationship...thatls what is pleasing to God..."go and cleave" to another ( I.e. a person of the opposite sex) ("a man shall leave his father and mother and shall cleave to his wife, and they shall become one flesh, and the man and his wife were both naked and they were not ashamed" Gen 2.24-25) and what about Matt 5.27 and "adultery in the heart" ? Of course, I don't like libraries that have internet so obsessively triggered to block any & all websites that MIGHT contain "adult images" (but might not; at one library they block youtube and also a site named scribd which is mostly written documents, not a video site, and definitely not aimed towards adult content) ..so the body is good & sex is good, but lusting and adulterey in the heart is bad..but what about when yu r still single and searching ? is it ok then ? I'm still not so sure its healthy. I don't even think a quality relationship should begin based solely on physical qualities. Maybe that's why we have a divorce problem in the USA . ..anyways, I also posted a video of me at a library facetiously being "tempted" by adult material on the website ("I confess..." ..with the point being to raise this matter as an issue of concern and to talk about it, online, aand to give my theological viewpoint(s) as I also continue to grow and learn...and still, occassionally, yearn for a committed relationship with the right person of the opposite sex. God bless you all. Pray for those who are addicted to porn or other material(s) (drugs, etc)...that keeps them constanly "pumped up" but not in touch with reality ...and not participating as citizens in trying to make this world a better place for everybody..ultimately, the incessant viewing or pornography (and especially those who "get off" on it, I.e. masturbate) is simply a problem of being SELFISH...and it causes other social problems..if you are trapped in a cycle of addiction, there are ways to BREAK FREE...and of course I always talk about Jesus Christ as the Way, and ultimately the only way, but if that's not your cup of tea (coming to Christ involves commitment and work) there are other forms of treatment for addiction..search the web, you'll find it..be brave enough to ask for help...let us all keep growing either in faith or in citizenship or both and keep making this world a better place for all...both men & women..set aside your selfish habits that you may say is your "legal right" but nonetheless is harmful in some ways to the betterment of society..I invite you to take a new step toda..for Christians...as we approach Easter three days from now..we are at the end Of Lent and I hope u gave up something for a while..and if it was a selfish addiction don't go back to it...leave it behind forever..have courage, God will not let you down...!

Hey - que passe?

You’re right, I recently flipped out - whatever possessed you to write to me after not having seen me for nearly a yr. and a half? - A pleasant surprise, at any rate. Your questions seem to be an order of multiple choice so I’ll answer them as such:

How am I?
[_] alive
[_] dead
[x] sort of inbetween

Am I...
[x] in school
[_]at home
[x] working
[x] in love
[x] or what ?

I transferred to Univ. of South Fla. (in Tampa) and have been going here since June ‘72 - I’m working part time and was living with a guy (since I left G’ville in December ‘71) - the guy was from Chicago - went to school at Southern Illinois Univ. After Xmas (’71) I came back to Greenville with him, we packed up my stuff & trucked up to Illinois where I spent 3 mo. with him at school there. Then we came to Fla. in March & messed around some till I started school in June. Things went great until I decided I was leading a married life at my young ripe age of 21 (now legal in every state of the union), so I ran off with his best friend in order to assert my independence - 3 wks. ago - I guess I screwed up a good thing (if you’re into marriage) and of course he still loves me & vice versa, so if I ever get my shit together within the next couple yrs. I guess we’ll move back in together, but until then I guess I’m more or less non directional.

That’s my life in a nutshell since I left G’ville - good to hear the old ECU is changin’ - so what are you majoring in and are you working? How is your wife, or is she? Do you ever see anything of Whit, or the old Bentley’s people? Does Darlene (the little blonde) still work at the Country Store> We wrote to ea. other for quite a while bit I haven’t heard from her for a couple months. As a matter of fact, I’ve lost contact with everyone I used to write to there. I was gonna stop by G’ville on my way up to Pittsurgh for Xmas but I ended up flying so that blew that idea - all my clothes are still sitting in the AD? house so I may get up there sometime yet. Let me know what you’ve been up to -

take care

Luv -

Getting Really Old

Getting Really Old

I've known Marion Barry for more than 30 years. I also covered his many adventures for more than a decade.

At 73, he is not the strong, charismatic figure who once moved across the national scene at a time when American politics was opening up to diversity.

The womanizing, the substance abuse, the chronic tax problems, prison time... I can't imagine that being the way I would want to be remembered.

Barry is not a rich man. He still needs to earn a salary at an age when most of us hope to be kicking back and retired.

He once told me proudly, " No one can say I ever stole a dime." But , I think there comes a time when you want to try to live in ways that keep law enforcement out of your life.

Some very good lawyers will work to resolve these latest issues for Mr. Barry. Maybe he won't have problems with his probation-- he is under supervision until 2011.

He is a public figure with problems. I've heard the expression "everyone loves a bad boy." WHY?

An Unbiased View of Professional Employer Organizations

An Unbiased View of Professional Employer Organizations

Businesses today need help managing increasingly elaborate employee matters like health benefits, workers compensation claims, payroll, payroll taxes, and unemployment claims.

Contracting with a Professional Employer Organization, (PEO), can be extremely helpful to businesses in these matters. With a co-employment contract, for example, the Professional Employer Organization, (PEO), actually becomes the employer-of-record for most purposes, including insurance and taxes, and files the paperwork necessary using its own employer identification numbers. The client organization then continues to manage and direct the employees daily activities.

Professional employer organizations (PEOs) enable clients to cost-effectively outsource the management of human resources, employee benefits, payroll and workers compensation. PEO clients focus on what theyre good at to grow their bottom line.

A Professional employer organization provides integrated services to manage important human resource responsibilities as well as employer risks for their client organizations. A PEO delivers these services by establishing and maintaining an employer relationship with the employees at the clients office and by contractually assumes certain specific employer responsibilities, rights, and risks.

A Professional Employer Organization earns its income partly by using different methods of wage, insurance and tax arbitrage. With insurance products, a Professional Employer Organization will purchase workers compensation, employment practices liability and employee benefits insurance at an established price. The Professional Employer Organization then adds a markup to the premium costs and then bills the updated rate to the client. This new rate would still be less than what the client company would have paid on its own.

THe client organization benefits since Professional Employer Organizations saves time and staff who would otherwise be used to perform tasks like preparing payroll, administering benefit plans and more. Additionally, it will most likely reduce legal liabilities and/or obligations to employees that it would otherwise have. The client organization may also be able to offer a better package of benefits, and so be in a position to attract better skilled employees.

So the Professional Employer Organization model can be very attractive to small and mid-sized businesses and associations. Professional Employer Organization marketing is typically directed toward these segments.

St Mary, Akenham, Ipswich

The war memorial at Akenham contains just three names, all with the same surname:

Amos Purkiss, son of William Purkiss, of Akenham, Ipswich; husband of Mary Purkiss, of 265 Spring Road, Ipswich. Trimmer Cook, Royal Naval Reserve. Died 25th November, 1916, aboard HM Trawler Burnley. He was 36 years old. His body was never recovered. Remembered on the Chatham Naval Memorial, Kent.

George James Purkiss, 2nd Batallion, Norfolk Regiment. Died 1st December, 1915. Family and age unrecorded. His body was never recovered. Remembered on the Basra War Memorial, Iraq.

Philip Edgar Purkiss (recorded by CWGC as Arthur Edgar Purkiss), son of Robert William and Ada Purkiss, of Akenham, Ipswich. Lance Corporal, Machine Gun Corps (Infantry) Died 24th September, 1917. during Third Battle of Ypres. His body was never recovered. Remembered on the Tyne Cot Memorial, Belgium.

East Anglia has more remote churches than Akenham, but can any be so lonely? Here we are, just four miles from the Cornhill in the centre of Ipswich, with the blocks of flats on Whitton within sight, but almost a mile from the nearest proper road and with just two old farmhouses for company.

Standing here on a narrow, muddy track through the fields, I find myself easily transported back through more than a century. I must turn my back on Whitton, one of Suffolk's biggest and most deprived housing estates. Barely a mile from where I now stand, I have seen children play in the wrecks of burned-out vehicles; any weekend, police helicopters light up the night as they track the course of joyriding car thieves. I turn my back on the houses and the distant traffic of the A14, on the little spire of Whitton's pretty parish church. And all I hear is the skylark invisible above me, the gentle rush of the wind in the hedgerow, the sound of a dog from nearby Rise Hall.

In front of me stands St Mary, Akenham. Along with Rise Hall, this little lost church was the scene of one of the great ecclesiatical scandals of the 19th century, a scandal that occupied the national press for a year or more; a scandal that reached the highest courts in the land, and ultimately led to a change in the law. It is the story of a conspiracy, a tale of manipulation and persecution. Even more than this, it was a watershed in the controversy surrounding the Oxford Movement, and the irresistible rise of Anglo-catholicism.

To find out what happened here, let us go back a little further, to the 1860s. The vicar with charge of this parish was the rector of Claydon, Father George Drury, one of the new breed of ultra-ritualists. His introduction of candles and a cross on to the altar at Claydon, as well as vestments, daily communion and even incense, scandalised the local protestants, and led to his admonishment by the Bishop of Norwich. For all these things were quite illegal, of course; several priests had been prosecuted, and a few of them imprisoned, one for more than a year. Others were persecuted into breakdown, early death and even suicide.

Drury's greatest crime, in the eyes of his opponents, was the establishment at Claydon of religious communities, firstly of men, and then a convent of sisters. We may well imagine the effect on a Suffolk village of Father Ignatius, the exotic monk who led the first community here, moving it to Norwich and then to Wales, where it still survives as a Catholic community on the island of Caldy.

What enraged popular opinion, though, was the convent. Father Drury was accused of keeping a harem, an outrageously offensive slur in the mid-19th century. On one occasion, a local mob broke into the convent and 'rescued' a nun; she was conveyed to a lunatic asylum by order of her father, and incarcerated there until his death. Anti-catholic slogans were painted on Drury's rectory, and he built a nine foot wall around it to protect it.

But Claydon is a big village, and we may presume that he found as many enthusiasts as enemies there. Supplemented by adherents from a wide area, his Anglo-catholic services at Claydon were very popular, despite constant interference from the Bishop of Norwich, who on one occasion threatened him with suspension for saying services in an unlicensed preaching house - that is to say, he celebrated communion in the convent. He was also accused of calling communion 'Mass'.
This all seems very amusing today, but we need to remember that burning passions were inflamed; popular opinion, and at times the Law, were not on the side of George Drury.

If Claydon was a busy church, then Akenham was quite the opposite. As I say, Claydon was, and is, a large village; now combined with Barham, it is virtually a small town.

But Akenham, in the 19th century, could muster barely 70 souls (and a fraction that number today). More than this, virtually all the inhabitants were non-conformists, largely because the two major landowners, Mr Gooding of Akenham Hall and Mr Smith of Rise H

Each Sunday, they would load up their carts, and take their employees off to chapel. Akenham sexton Henry Waterman could rightly claim in 1878 that he was the only Anglican churchman left in the village.

Then, as now, it was left to the people of the parish to elect a churchwarden; unsurprisingly, it was usually a local landowner, and the people here elected Mr Smith of Rise Hall, despite the fact that he wasn't an Anglican. Equally unsurprisingly, Father Drury refused to recognise the appointment (although it was recognised by the Bishop of Norwich) and also refused to allow Smith to hold the keys to Akenham church.

Every Sunday, Father Drury set off across the fields to hold a service at Akenham church. It is still possible to walk this journey between the two churches along a bridleway - it is le

Yves Saint Laurent kicks back at Christian Louboutin

Yves Saint Laurent kicks back at Christian Louboutin

YSL has begun a campaign against Louboutin and his famed shoes on the basis that the latter is certainly not the only shoemaker to adorn his creations with luxurious red outsoles.

"Red outsoles are a commonly used ornamental design feature in footwear, dating as far back as the red shoes worn by King Louis XIV in the 1600s and the ruby red shoes that carried Dorothy home in 'The Wizard of Oz' " said YSL in court papers.

This latest development in the ongoing feud began in April when Louboutin slapped YSL with a USD 1 million trademark infringement suit.

YSL now alleges that Louboutin fraudulently claimed "exclusive" use of red soles in his trademark application. "As an industry leader who had devoted his entire professional life to women's footwear, Mr. Louboutin either knew or should have known about some or all of the dozens of footwear models that rendered his sworn statement false, " YSL claims.

Not only does YSL claim that it has been selling shoes with crimson soles since the 1970s, long before Louboutin began his fashion line, but also that Louboutin's suit is part of an "anti-competitive campaign " that included pressuring high-end retailers like Saks and Neiman Marcus to pull YSL's shows off their shelves.

Louboutin's lawyers have not yet commented on the matter.
