A very long post about a dearly beloved friend (vs. Paramount) FOR IMMEDIATE RELEASE ELLISON SUES STAR TREK Harlan Ellison, multiple award-winning writer of the famed teleplay for the original Star Trek episode, City on the Edge of Forever, sued Paramount on March 13, 2009 for failing to account to, or pay, Mr. Ellison for the merchandising, publishing, or any other exploitations, of the famous teleplay, from inception to date. The suit also names the Writers Guild of America and alleges the WGA failed to act on Ellison’s behalf after numerous requests. Ellison’s City on the Edge of Forever (the memorable episode starring Joan Collins as salvation sister Edith Keeler, the woman Kirk loved and watched die; remember?) continues, 35 years after its original NBC airing, to receive critical accolades, and has become legendary as one of the all-time money-making commercial favorites: it won the coveted Writers Guild award for year’s best teleplay; it won the “Hugo” award of the World Science Fiction Convention; it was ranked as one of the “100 Greatest Television Episodes of All Time” by TV Guide in 1997 as part of its 50 year survey; it was “One of the 100 Most Memorable Moments in Television History” in the 29 June 1996 nationwide survey; and as recently as its 20-26 April 2002 issue, TV Guide celebrated Star Trek’s 35th anniversary featuring, of the hundreds of episodes since its debut, its 35 Greatest Moments! Harlan Ellison’s City on the Edge of Forever was #2. Mr. Ellison’s attorney, John H. Carmichael, points out that the 1960 collective bargaining agreement between the WGA and the Producers, as amended in 1966, assures to the writers of individual teleplays “a piece of the pie.” Specifically, Mr. Carmichael states, “Writers under that WGA agreement are supposed to get 25% of the revenue from the licensing of publication rights. From Dollar One. Here, Paramount licensed its sister-corporation Simon & Schuster, through its Pocket Books division, the right to publish a knock-off trilogy of paperbacks – the ‘Crucible’ series – novels based on City, using Ellison’s unique elements: plot, specific non-Trek characters, prominently including The Guardian of Forever, singular conceptual uses of time travel, the sense of tragedy that propels the story, the mood and venue of the story in the 1930s Great Depression, and at the stories’ heart, pivotally, whether Edith Keeler lives or dies. Not merely minor points or window dressing or name-changes. No, they are the body, heart, and guts of Mr. Ellison’s original creation – the best story Star Trek ever told. “But even as flagrant in evidence as is this case, Paramount has gone tabula rasa. Paramount will not respond to any alleged Guild requests for an accounting. Not just for the books, but for much City-related merchandise, such as a Hallmark Christmas ornament of the “talking” Guardian of Forever actually using lines Ellison wrote for his script – obvious re-uses of Ellison’s singular creation, for which he should be compensated. Paramount will not send statements; Paramount will not admit anyone is owed anything; and even when the WGA requests an accounting, they are blown off with – ‘we’ll get back to you,’ which they don’t. And the WGA seems routinely to accept such cavalier non-responsiveness without a fight. Paramount will not permit examination, and will not open the books; perhaps for fear of loosing a Super-Accountant/Pandora on them, who will open holes in their duplicity. But the WGA is clearly unwilling to take action on Mr. Ellison’s behalf, and so we must seek intervention of the Federal Courts to ensure that the principles of the collective bargaining agreement are upheld. Mr. Ellison is singularly reluctant to sue his own labor union, of which he has been a 47-year member, a valued public spokesman, and where he has twice served on its Board of Directors. In this fractious matter, Mr. Ellison is only asking for one U.S. Dollar from his Guild. But he wants a judicial determination as to whether the WGA is doing what its stated purpose has been since day-one! To fight and negotiate for him and other writers. To obtain misappropriated, withheld, hidden earnings, no matter how minuscule or difficult to retrieve – but HIS, nonetheless. These are intended, true, benefits from earlier WGA bargaining agreements. But after waiting patiently either for the Guild to move against dismissive Paramount, or for Paramount to have a brain-flare of honesty or integrity, these huge sums due continue to be dumped into the studio’s ever-hungry maw. Mr. Ellison wants every penny of his long ago agreed-upon share of the revenue from Paramount’s relentless Trek exploitations, which have been unbelievably, financially remunerative in demonstrable measure as a result of Mr. Ellison’s significant contribution to the original Star Trek series.” Carmichael highlights: LA Times, 28 July 2007: “Paramount DVD sampler collects favorite epis Assistant Chief Constable Assistant Chief Constable Assistant Chief Constable (ACC) is the third highest rank in all British territorial police forces (except the Metropolitan Police and City of London Police, in which the equivalent rank is Commander, and Dumfries and Galloway Constabulary and the Northern Constabulary, which have no officers of this rank), as well as the British Transport Police, Ministry of Defence Police and Civil Nuclear Constabulary. Each force has between one and five Assistant Chief Constables. They are the lowest officers at Chief Officer level, below the Chief Constable and Deputy Chief Constable, and rank immediately above Chief Superintendents. Assistant Chief Constables usually hold portfolios (e.g. for crime, operations or territorial policing). ROYEL TAFT - Waterbury CT This is 8 year old Royel, he is my grandson and an impaired driver killed him July 14, 2006 as he played in his yard in Waterbury, CT USA. I took this picture of him just 3 weeks before he was killed in the very same yard. This is my last photo of him.....June 2006... A convicted felon killed him as he played in his yard in Waterbury, CT. Natasha Kinion pled guilty to 1st degree Manslaughter and Possession of Crack Cocaine and Possesision with intent to sell Crack Cocaine charges and was sentenced in Waterbury Superior Court, September 05, 2008 to 25 years suspended after 14 years in prison and 5 years of probation. It was her 5th felony conviction and the first time being sentenced to a prison term. Her Attorney, Martin Minella, argued that his client was the product of a broken home and had lost her mother at a young age. Her crimes could have resulted in a 30 year prison term, however, a PLEA DEAL was made between her attorney and the Office of The State's Attorney in Waterbury, CT. resulting in what our family feels was a sweet deal, yet again, for the defendant in Waterbury Superior Court. Her prior convictions and subsequent "sweet deals" were handed to her in the very same court, Waterbury, Connecticut Superior Court. Had she been sent to prison for her earlier felony drug convictions perhaps Royel would be here with us today. Death of Bessie Cross 1917 - Temple Meads Bristol Private Albert Cross of the 'Glosters' Regiment, appeared in court, charged with her murder. This case involves a soldier returning to the front, who shot his wife at the station on October 15, 1917, as the early morning train to London was due in at Temple Meads' busy platform five, waiting passengers and their friends were startled by the loud crack of a rifle. Then, with horror, they saw the body of a young woman lying slumped at the foot of a soldier. The infantryman was immediately apprehended by the Military Police and blurted out: 'I have shot my wife - she is in a certain condition by another man.' The 27-year-old pregnant woman, Bessie Cross, died of abdominal injuries and shock within minutes of being admitted to the General Hospital. A few hours later her 32-year-old husband, Private Albert Cross of the 'Glosters' Regiment, appeared in court, charged with her murder. He pleaded not guilty. It's hard for us, nearly 100 years on, to imagine what life was like in those far-off Edwardian days. One year into the Great War, casualty lists were appearing daily in the local press, peppered with smiling studio portraits of the latest dead or wounded soldiers. But the public image of their menfolk's noble sacrifice disguised a grim reality. Thanks to conscription, the enormous loss of young men's lives and women's war work, normal family life, for many people, lay in shreds. There was a new type of woman, liberated from moral constraints by the war's unexpected bonus of well-paid jobs, which has formerly been done by men. The men in the trenches resented the way that women had taken their jobs, while the older generation, brought up under strict Victorian morality, were shocked by their 'free and easy' behaviour. Albert Cross, the one-time painter from Baptist Mills, became a symbol for the suffering of our brave lads facing the horrors of war. Poor old Bessie was cast in many eyes as a loose, promiscuous, 'new woman'. The courtroom drama was acted out while the horrors of Passchendaele were unfolding, but the public were far too deeply involved with the morality of the 'Albert and Bessie' case to be overly concerned about the death and suffering of the 'brave lads' just 250 miles away. Albert denied the charges and by the time he reappeared in court to be committed to Bristol Assizes a week later, the case had attracted so much attention that crowds of disappointed spectactors had to be turned away. The prosecution outlined their case against him. After 10 days' leave Albert had been about to catch the London train en route to France. Bessie - just like other service wives and sweethearts on the platform that morning - had gone to say farewell. The couple had been through a great deal. Two months previously, as Albert set off to the front yet again, he had received a venomous letter from a married man called James King, boasting of an affair with Bessie who, he said, was now carrying his child. Albert and Bessie had then exchanged piteous letters. She begged his forgiveness and he finally accepted her pleas. Friends agreed that, during his leave, the couple seemed reconciled. Illegitimacy rates had soared during this period but the marriage looked set to survive a not unusual war-time lapse. But there was no denying the witnesses who had seen Albert finger the trigger of his rifle before pointing it at Bessie. The private stayed silent throughout the committal proceedings. His defending solicitor, Mr Watson, told the court he would not put his client in the witness box. He went on to say that it was up to the prosecution to make their case against the soldier, not for Albert to defend himself. He also signalled that the trial would be based on a tidal wave of sympathy for a 'war hero cheated by his cheating wife'. As Mr Watson continued with his defence he seemed near to tears. He said that in all his years as a criminal lawyer, he had never been so touched by a case. One of the soldier's letters to Bessie, he said, 'deserves to be preserved in gold. I have never in my life heard such a noble act of forgiveness as Albert Cross displayed.' Albert might have showed no emotion as he was committed to Bristol Assizes but he was one of the few people in the city to remain unmoved. The evidence against him was damning - but the emotional tidal wave in his favour was overwhelming. The jury found him not guilty of murder. Why? Purely because Bessie had been pregnant with another man's child. While Albert was bravely fighting for his country, said the moralists, his wife had been living as someone else's mistress. The war had turned the old, established Victorian values upside down and, in uncertain and changing times, the citizens of Bristol were touchier about morality than they had ever been before. The city's young women, with husbands and boyfriends boyfriends away at the Front and newly-liberated by well-paid war work, were relishing their new found freedom - both Scooter Accident: Leg Injuries The bulk of the damage happened to my left knee (deja vu...). Right after the accident the lumps in my knee were so frighteningly unnatural that I thought (while in shock) there was a good chance I'd need surgery. The doctor, who spoke English (yay!), poked and prodded and pushed and pulled and determined that nothing was broken. Indeed, I could (gingerly) walk on it as long as I kept the leg stiff. The next day, after icing and elevation, the swelling and pain had gone down. Today, two days after the accident, it's almost hard to tell that there is anything wrong. Unless you see me walk. I can sit and bend the leg to 90 degrees alright, but I still have to walk with a stiff leg, and very very slowly. :( I tried to take a pic in the doctor's office, but my camera battery chose that moment to give up the ghost. The Way We Were ::: 1957 ::: CANADA The ROLL-OUT of the CF-105 Avro Arrow…here again at the Toronto Aerospace Museum in 2006~ AVRO CANADA was "wrapped up" very quickly after PM Diefenbaker cancelled the Arrow interceptor and Iroquois engine programmes. Former Avro employees were sought out immediately, by eager American and British aerospace employers. THESE VERY ex-Avro Canada engineers went on to produce Lougheed, McDonnell-Douglas and Boeing aircraft, the Concorde and then THEY PUT America in space! Yup…Diefenbaker's irrational posturing (with Crawford Gordon, President of AVRO CANADA in 1959) and final decisive stupidity, set ALL THAT, Canada's first BRAIN DRAIN, in motion. NEWLY-ELECT Prime Minister Diefenbaker, who preached "a brave new world" as his campaign promise…in the end, completely lacked ANY VISION or bravery whatsoever. FOREVER TO BE REMEMBERED, as that "small town prairie lawyer" who rose to the occasion, at that defining moment, so drunk with "newfound" power and who so enraged, deliriously and maliciously, demanded an end to our (AVRO CANADA's) momentous cutting-edge, and preeminent aerospace achievements…and We…WE, the slumbering citizens of Canada, just as lost for letting him shamefully end it! EVERY TIME I think of this needless and HORRENDOUS aviation tragedy, the death of the Arrow interceptor and the Iroquois engine projects, how close we came, I get so mad…DAMN IT…I don't know what to do!!!!!! You'd think the years would lessen the blow! Nope. IF THIS reflective RAGE doesn't still consume you…even now…well then, you just can't be all that Canadian~ But jus’ so you don’t think the AVRO Arrow was any ole’ plane… here are: CF-105 AVRO Arrow “FIRSTS and NOTABLES” • First a/c designed with digital computers being used for both aerodynamic analysis and designing the structural matrix (and a whole lot more). • First a/c design to have major components machined by CNC (computer numeric control); i.e., from electronic data which controlled the machine. • First a/c to be developed using an early form of "computational fluid dynamics" with an integrated "lifting body" type of theory rather than the typical (and obsolete) "blade element" theory. • First a/c to have marginal stability designed into the pitch axis for better maneuverability, speed and altitude performance. • First a/c to have negative stability designed into the yaw axis to save weight and cut drag, also boosting performance. • First a/c to fly on an electronic signal from the stick and pedals. i.e., first fly-by-wire a/c. • First a/c to fly with fly by wire AND artificial feedback (feel). Not even the first F-16's had this. • First a/c designed to be data-link flyable from the ground. • First a/c designed with integrated navigation, weapons release, automatic search and track radar, datalink inputs, home-on-jamming, infrared detection, electronic countermeasures and counter-countermeasures operating through a DIGITAL brain. • First high wing jet fighter that made the entire upper surface a lifting body. The F-15, F-22, Su-27 etc., MiG-29, MiG 25 and others certainly used that idea. • First sophisticated bleed-bypass system for both intake AND engine/exhaust. Everybody uses that now. • First by-pass engine design. (all current fighters have by-pass engines). • First combination of the last two points with an "ejector" nozzle that used the bypass air to create thrust at the exhaust nozzle while also improving intake flow. The F-106 didn't even have a nozzle, just a pipe. • Use of Titanium for significant portions of the aircraft structure and engine. • Use of composites (not the first, but they made thoughtful use of them and were researching and engineering new ones). • Use of a drooped leading edge and aerodynamic "twist" on the wing. • Use of engines at the rear to allow both a lighter structure and significant payload at the centre of gravity. Everybody copied that. • Use of a LONG internal weapons bay to allow carriage of specialized, long-range standoff and cruise missiles. (not copied yet really) • Integration of ground-mapping radar and the radar altimeter plus flight control system to allow a seriousstrike/reconnaissance role. The first to propose an aircraft be equally adept at those roles while being THE air-superiority fighter at the same time. (Few have even tried to copy that, although the F-15E is an interesting exception.) • First missile armed a/c to have a combat weight thrust to weight ratio approaching 1 to 1. Few have been able to copy that. • First flying 4,000 psi hydraulic system to allow lighter and smaller components. • First oxygen-injection re-light system. • First engine to have only two main bearing assemblies on a two-shaft design. • First to use a variable stator on a two-shaft engine. • First use of a trans-sonic first compressor stage on a turbojet engine. • First "hot-streak" type of afterburner ignit Search Engine Optimization with Blogging We will be training our lawyers shortly on the value of blogging. Bristol Quakers We look back at how the history of the Quaker movement has close ties with Bristol. WHAT could the founder of an American state, a family of chocolate-makers, the builders of two bizarre grottoes and the owner of a lunatic asylum possibly have in common? The answer is more in heaven than on earth - they were all Quakers. Bristol was an early stronghold of the Quakers and many of the leading families were members. The contributions of the Quakers to Bristol's prosperity - despite appalling persecution - has never been properly documented. The Fry family, who founded the chocolate empire and were noted prison reformers, were Bristol Quakers. And William Penn, founder of Pennsylvania, lived and married here. William Champion, builder of Europe's biggest brass foundry and the amazing Warmley grotto, was a Quaker; so was Thomas Goldney, merchant and creator of the equally remarkable Goldney House grotto in Clifton. Clark's, the famous shoe-manufacturing family; Morlands, the sheepskin people Cottrells (wallpaper); Sturge (estate agency and surveying); Woolley (caravans); Dr Fox, the Brislington pioneer of the treatment of the insane -- they were all members of the Society of Friends, the Quakers' proper title. Fox started the Society around 1652 and the movement reached Bristol in 1654. he was a stubborn and often incoherent preacher who refused to remove his hat to anyone on the grounds that God had told him not to, denounced all amusements and hated soldiers, priests and lawyers. Accounts of early meetings seem very far from the peaceful modern Quaker gatherings, with the mass hysteria and faintings typical of religious meetings of the time. Early Quakers were not averse to disturbing the services of other denominations and attacking their ministers - the Society has no priests - as charlatans and deceivers. Broadmead Church recorded bitterly: "They would frequently trouble us, shaking, trembling, or quaking like persons in a fit of the ague, while they spake with a screaming voice." And that's how the Society got its familiar nickname, although Fox called his society the Friends of Truth - Friends for short. Quakers in Bristol were in turn heavily persecuted for their unconventional beliefs - their meeting houses were broken up and members were beaten, imprisoned and accused of blasphemy. Many died in the appalling Newgate gaol and there were heavy fines for non-attendance at Church of England services. George Fox himself spent much time in the city and married Margaret Fell at a Broadmead meeting. After a preaching visit to America and the West Indies, he sailed back to Bristol, and saved two of the ship's crew from being press-ganged into the navy before landing at the "town" of Shirehampton. The first Quaker meeting-house was probably in Broadmead, but one of the oldest surviving is a thatched house at Portishead, which dates from 1669, when friends in the north Somerset villages were being dreadfully harassed by the authorities. Early Quakerism seems to have been as repressive and intolerant as most other religious movements, with dress restrictions, expulsion for marrying outside the Society and a ban on drink and tobacco. But the Quakers looked after their own, providing practical help for the poor, the sick and the old, as well as leading campaigns for urgent social reforms among the unbelievably poor pinmakers of Syston and the hatters of Oldland. The history of the Quakers has been embroidered in a remarkable tapestry - 75 panels covering 300 years - which was started in Taunton in 1981 and was on show in Bristol in 1991 to mark the 300th anniversary of the death of movement founder George Fox. John Butler YEATS (1839 Ulster-1922 New York) Anglo-Irish Painter John Butler Yeats (Born Tullylish, County Down, 16 March 1839, died 3 February 1922) was an Irish artist and the father of William Butler Yeats and Jack Butler Yeats. He is probably best known for his portrait of the young William Butler Yeats which is one of a number of his pictures in the Yeats museum in the National Gallery of Ireland. His portrait of John O'Leary (1904) is considered to be his masterpiece (Raymond Keaveney 2002). Educated in Trinity College Dublin and a member of the University Philosophical Society John Butler Yeats began his career as a lawyer and devilled briefly with Isaac Butt before he took up painting in 1867 and studied at Hearthleys Art School. There are few records of his sales, so there is no catalogue of his work in private collections. It is possible that some of his early work may have been destroyed by fire in WWII. It is clear that he had no trouble getting commissions as his sketches and oils are found in private homes in Ireland, England and America. His later portraits show great sensitivity to the sitter. However, he was a poor businessman and was never financially secure. He moved house frequently and moved several times between England and Ireland. At the age of 69 he moved to New York, where he was friendly with members of the Ashcan School of painters.
